Following the running of Race 8 an information was lodged by the Stipendiary Stewards instigating a charge against T S Chmiel, the driver of Keepthepeace, under Rule 869 (3) (b).

DECISION & REASON
--Following the running of Race 8 an information was lodged by the Stipendiary Stewards instigating a charge against T S Chmiel, the driver of Keepthepeace, under Rule 869 (3) (b). The Stipendiary Stewards alledged that with approximately 650 metres to run Mr Chmiel drove carelessly when attempting to shift Holmes Legend (D Butt) wider on the track causing Holmes Legend to break and lose ground.
----At the outset of the hearing the Committee noted that Mr Chmiel admitted the breach and did not wish to be present. The charge is accordingly found proven.

The Stipendiary Stewards showed a video of the incident that clearly showed Mr Chmiel racing two out and then attempting to move three wide when not sufficiently clear of Holmes Legend causing Holmes Legend to strike his cart and go into a break.
In respect of penalty the Stipendiary Stewards noted that Mr Chmiel had a clear record over the last 12 months in respect of the rule. The Stipendiary Stewards recommended a penalty in the vicinity of $250.00.
----The Committee, after taking into account by way of mitigation the good driving record of Mr Chmiel, and his early guilty plea, and noting that the changes of Holmes Legend were effectively extinguished, imposes a penalty of $250.00.
