Decision: Following the running of Race 2, Ford Two-Year-Old Series 800, an information was filed by Stipendiary Steward, Mr M R Davidson, against Apprentice Jockey, Miss S T Collett, alleging that Miss Collett rode carelessly in allowing her mount, RANSOM SUCCESS, to shift ground out when not clear
DECISION AND REASONS:
--Following the running of Race 2, Ford Two-Year-Old Series 800, an information was filed by Stipendiary Steward, Mr M R Davidson, against Apprentice Jockey, Miss S T Collett, alleging that Miss Collett rode carelessly in allowing her mount, RANSOM SUCCESS, to shift ground out when not clear causing CRYSTAL DUKE (J R Todd) to check near the 200 metres.

Miss Collett did not admit the breach and was assisted at the hearing by Licensed Trainer, Mr P J Williams.

Mr S C Ching, Stipendiary Steward, showed video replays of the final stages of the Race and pointed out Miss Collett riding her mount out, as was Mr Todd, with approximately 200 metres to run. Mr Ching conceded that the horse on Miss Collett’s inside did move out and that Miss Collett’s mount seemed to run away from it. The Stewards alleged that Miss Collett’s carelessness was in continuing to ride her mount out when she had the option to keep it on a true line. Mr Todd had to take evasive action to miss heels, Mr Ching said. Miss Collett had a duty to keep her mount on a straight line but had carried on riding and pushing. It was a quite sharp outward movement, Mr Ching said. Miss Collett had made a misjudgment in believing that there was no horse outside of her.

Mr Williams, on Miss Collett’s behalf, used the video replays to demonstrate that Mr Todd’s mount was under pressure and was starting to lay in. He alleged that Mr Todd’s mount had contributed to the incident as had the horse inside Miss Collett that made the initial outward movement. Mr Ching conceded that Mr Todd’s mount was laying in and that a number of horses were racing greenly, being 2-year-olds.

Miss Collett pointed out that her mount was a green 2-year-old racing left-handed for the first time. She submitted that Mr Todd’s mount had its head on the side the whole way up the straight wanting to run across her heels. Also, the horse on her inside had come out and her mount had run away from it. Her mount had run in a straight line prior to that point.

The Committee has carefully considered the evidence of both parties and we have carefully viewed the video replays. In the Committee’s view, the following points are significant:
----
1. It was a 2-year-old race and all runners were having their first raceday starts;
--2. Miss Collett’s mount’s outward movement was sudden and the Stipendiary Stewards have conceded that it was the result of the horse inside Miss Collett moving out. Miss Collett’s mount “ran away” from the horse on its inside. It had been maintaining a straight line prior to that point;
--3. The interference to Mr Todd’s mount happened within a stride or two;
--4. It is quite clear that Miss Collett made no attempt to straighten her mount but, in our opinion, that does not matter because the damage had already been done; and
--5. We think it irrelevant that Mr Todd’s mount had its head “on the side” and was, according to Miss Collett, trying to go across her heels.

The fact is that, in our opinion, the sudden outward movement that caused interference to CRYSTAL DUKE was probably not controllable by Miss Collett.

For the above reasons, we are left in some doubt to the extent that we are not satisfied, on a balance of probabilities, that Miss Collett rode carelessly and, accordingly, the charge against her is dismissed.

We wish, finally, to record that, in our view, the charge was quite properly brought by the Stipendiary Stewards.
