Following the running of race 4 an information alleging a breach of rule 869 (2) (a) was lodged the information alleged that junior horseman Mr. O. Gillies used his whip excessively when driving Aqua Shock over the concluding stages of the race.
--Mr. O Gillies admitted the breach of this rule and was present at the hearing of this information.
--Mr. B Lee, senior horseman was present to assist Mr. Gillies.
--Mr. Muirhead showed the video of the concluding stages of the race and this showed Mr. Gillies striking his horse with the whip on approximately 22 occasions in the run home.
--Submissions were heard on penalty from both Mr Muirhead and Mr Gillies
--Mr Muirhead advised that Mr Gillies had not had a charge under this rule previously and had a clean driving record.
--Mr Muirhead sought a fine in this instance.
--Decision and Reasons.
--Having taken into consideration the good record of Mr Gillies and also his admission of the breach of this rule , also the submissions from Mr Muirhead a fine of $200.00 was imposed in this instance.
--Mr. Gillies was advised that a repeat breach of this rule in the future may result in a suspension of his horseman's licence.
