DECISION AND REASON:
--This inquiry concerns a protest lodged following the running of Race 2. The protest was lodged by Stipendiary Steward, Mr AR Coles, alleging that SKIMMIO or its rider, placed first by the judge, interfered with the chances of CASTLEBAR placed second by the judge. The interference occurred in the final straight.
--The margin between first and second was 2-1/4 lengths and Mr Coles reserved the right to charge Mr Walker.
--SKIMMIO was represented by Mr M Walker. Mr M Cameron, rider of CASTLEBAR, and Mr A Sharrock represented the connections of CASTLEBAR.
--Before viewing the video Mr Coles questioned Mr Cameron as to the distance he felt he had lost through the apparent interference at the 200-metre mark. Mr Cameron replied that he felt he had lost 1-1/2 to 2 lengths in the incident. After further questioning he re-assessed the distance to be 2 to 2-1/2 lengths.
--Mr Robinson demonstrated the video, which clearly showed SKIMMIO moving inwards and taking the line of CASTLEBAR after entering the straight. CASTLEBAR was unbalanced for 2 ? 3 strides before finishing strongly for second place, 2-1/4 lengths from the winner.
--Mr Sharrock said CASTLEBAR was a big striding 2-year-old who took some time to regain momentum after such a check. He noted that CASTLEBAR was finishing strongly.
--Mr Cameron confirmed Mr Sharrock's observations and thought he heard his mount clip heels 2 ? 3 times.
--Mr Walker said he moved up on the outside of Mr Cameron to assist him get his mount which he felt was hanging quite badly round the turn. His mount had then unexpectedly moved in but had galloped strongly to the line.
--In summing up Mr Coles said that although interference had taken place the effect of such interference to a long striding 2 year-old that took some time to rebalance had to be balanced against the 2-1/4 length margin at the finish.
--The Committee agree that interference did take place at the top of the straight. In exercising their discretion they took into account:

- The affect the interference had on CASTLEBAR. --
- The Judge's margin of 2-1/4 lengths. --
- The way both horses went to the line.
The Committee reached the conclusion that the affect of the interference was not enough to change the Judge's placings. The protest was therefore dismissed and the Judge's placings stand.
