CHARGES:
--Following Race 3 (‘Farewell Fiona Pickering 1340’), an Information was filed pursuant to Rule 636 (1)(c). The Informant Mr Neal alleged that Mr Rarere failed to ride his mount, WHOSMEMUM, out to the finish of the race when required to do so.
----
FACTS:
--Rule 636 (1)(c) states: “…the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.”
----
Mr Neal read the rule, and Mr Rarere confirmed he understood the rule and his admittance of the breach.

Mr Neal demonstrated the video films and pointed out to the Committee Mr Rarere’s mount, WHOSMEMUM, racing in a position near the running rail. During the concluding stages of the race it was clear in the video films, that Mr Rarere elected to sit up on his mount two to three strides short of the post, losing fifth position over the final few metres.

SUBMISSION(s):
--Mr Neal indicated that stewards had spoken with Mr Rarere after Race 3, who indicated that his mount was primarily a 1200 metre horse, which struggled over the 1340 metres. Mr Neal acknowledged that Mr Rarere’s mount may have appeared to be coming to the end of its run; however, it was his view that Mr Rarere had an obligation to ride out to the line, and his failure to do this had cost connections fifth position.

Mr Rarere reiterated to the Committee his view that WHOSMEMUM was more suited to 1200 metres, was on its final legs. Mr Rarere stated that he did not believe he could have done much more given this was a race run over 1340 metres.

DECISION:
--The committee found the charge proven.

SUBMISSION(s) ON PENALTY:
--Mr Neal indicated that Mr Rarere had no charges in the previous 12 months. Although Mr Rarere does not have many rides, Mr Neal submitted that a fine would be the most appropriate penalty, and asked the Committee to consider a fine that was no less than the stake money for fifth position on this occasion.
--Mr Rarere submitted that the proposed fine put forward by Mr Neal was more than a riding fee, and given that WHOSMEMUM was his only ride for the day he would be financially disadvantaged. Mr Rarere, when asked, had nothing further to add.

REASON(s):
--The Committee considered the submissions of both parties. We gave acknowledged Mr Rarere’s admission of the breach and his good record; having no previous charges during the last 12 months. However, the Committee was of the view that Mr Rarere’s failure to ride his mount out to the finish had cost the connections fifth stake money, and the breach would be best dealt with by way of a monetary penalty.

PENALTY:
--Accordingly, after taking the above facts into account the Committee imposed a fine of $200.
