Mr Oatham alleged that Ms Johnson was guilty of careless riding in that she allowed her mount SOMOYA to shift ground outwards near the 1400 metres when not sufficiently clear of TARBACH, which was badly hampered near the 1200 metres. Ms Johnson admitted the charge, which we thus find proved.

--Mr Oatham had Mr Williamson, stipendiary steward, show the incident on the videos. He demonstrated that Ms Johnson on SOMOYA moved away from the rail into the line of TARBACH when not her length and another length clear. Mr Lammas on TARBACH was put off stride and was forced 3 wide. Mr Williamson commented that Ms Johnson was at best 1/2 a length clear.
--Mr Newham on Ms Johnson’s behalf said she had made an error of judgment in that she had believed TARBACH was going backwards when she moved out, whereas the horse was in fact being hunted up.
--Mr Oatham described the incident as bottom end and asked for a suspension. He produced Ms Johnson’s record which showed three breaches of this rule this season but with her record being clear since April.
--We view the breach as being towards the lower end of the range. Mr Lammas was forced to take hold of his mount and to shift ground as a consequence of Ms Johnson’s outwards movement. We view Ms Johnson’s clear record these past 7 to 8 months to be very good, especially when regard is had to the substantial number of rides she would have had in this time. We also give credit for her ready admission of the breach. We grant Ms Johnson’s request that the suspension commence after Saturday’s racing. She is suspended from the end of racing on Saturday 5 December up to and including Friday 11 December. This 4 days.
