DECISION & REASON
--Following the running of race number 2 Mr S Renault, the driver of Rosie Bar lodged an information instigating a protest against Clintons Maid (6) L James on the grounds that Clintons Maid had caused interference to Rosie Bar causing that horse to break and lose all change after about 200 metres after the start. The Registrar advised that the Judge made his call at 1.41.40 and notice of the protest was given at 1.43.40.
----The relevant rule reads:

- The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which: ----
- may have gained an advantage by ay conduct or interference prohibited by any preceding provision of this Rule and/or ----
- may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, - --

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
----At the outset of the hearing Mr Renault said that he had been racing approximately three wide with Rosie Bar and Cliftons Maid was racing four wide and come across, cutting off, causing his horse to gallop and lose all chance. He also said that his horse had hit the wheel of Clintons Maid. Mr Renault used the video evidence to support his contention.
----Mr N Escott, the Stipendiary Steward, said that it was the Stipendiary Stewards’ view that Clintons Maid crossed Rosie Bar when clear and that in their view the movement of Clintons Maid was not responsible for the breaking of Rosie Bar. He then referred to the video evidence and demonstrated the incident and asked the Committee to note that when Rosie Bar broke that Cliftons Maid was some distance clear of it and already established in the three out line. It was also evident from the video evidence that Rosie Bar was pacing roughly prior to any movement inwards by Cliftons Maid. He also said for that reason the Stipendiary Stewards decided not to lodge a protest.
----Mr R Kennedy, the trainer of Cliftons Maid, confirmed to the Committee that he was representing the connections of Cliftons Maid and that it was his contention that Cliftons Maid had already completed its movement and was clear of Rosie Bar when that horse left stride.
----Mr L James, the driver of Cliftons Maid, gave similar evidence to that of Mr Kennedy but also used the video evidence to demonstrate the distance between the horses.
----The Committee, after giving consideration to the evidence of both the Informant, the Stipendiary Stewards and the connections of Cliftons Maid, is of the view that although Cliftons Maid did move from the four out to the three out position, that movement did not cause interference to Rosie Bar and, accordingly, the protest is dismissed.
----The placings are confirmed as they crossed the line:
