Following the running of Race 2, Berkshire Stud Syndicate Mobile Pace, Information No. 68181 was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr K M James, alleging a breach of Rule 869 (2) (a) in that Mr James, as the driver of PERAKI CHIEF, “used his whip excessively in the run home”.

DECISION AND REASONS:
Following the running of Race 2, Berkshire Stud Syndicate Mobile Pace, Information No. 68181 was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr K M James, alleging a breach of Rule 869 (2) (a) in that Mr James, as the driver of PERAKI CHIEF, “used his whip excessively in the run home”.

Mr James had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(2)   No horseman shall during any race:-
      (a)  use his whip in an unnecessary, excessive or improper manner.

--

Mr S P Renault, Stipendiary Steward, showed a video replay of the final 400 metres of the Race. He alleged that Mr James used his whip on approximately 26-27 occasions in the home straight.

Mr McIntyre informed the Committee that Mr James had a previous breach of the Rule on 21.8.09 when he was fined the sum of $200.

--

In determining penalty, the Committee took into account Mr James’ admission of the breach. However, it also had regard to the previous breach in August 2009.

Mr James was fined the sum of $300.
