| -- DECISION & REASON: --Following race 9 an information was lodged against T Harris (apprentice) alleging careless riding (Rule 871(1)(d). The charge alleges that he angled out for a run when not the required distance clear causing checks to SLEEPY JOE ridden by L Hofmann, and also TERRAIN ridden by M Du Plessis who both consequently lost ground. Mr Harris is an apprentice who is assisted by Mr M Williamson. ----Mr Harris pleaded guilty at the first opportunity. ----The only issue for determination is penalty. ----The incident has been demonstrated on the race video. ----After hearing submissions from the informant and Mr Williamson we have determined that a suspension be imposed. Taking into account your plea of guilty, very good record, your explanation, the fact that two horses were significantly interfered with. ----We accept Mr Oatham's submission that a suspension be imposed. We believe a starting point of 4 days, however taking into account your plea of guilty, your very good record and all the matters Mr Williamson has outlined, we will impose a 3 day suspension. Your suspension will start at the conclusion of racing on 10 November up to and including 17 November 2004. ------ --
