Mr Knowles, stipendiary steward, protested against the 2nd placing of RUBY ‘N DIAMONDS in race 1 on the ground that it broke from its gait approximately 60 metres from the winning post and failed to regain its proper gait. Mr Knowles sought disqualification pursuant to R 1003.

Defendant      Ms K Hill   horsewoman

Mr Knowles, stipendiary steward, protested against the 2nd placing of RUBY ‘N DIAMONDS in race 1 on the ground that it broke from its gait approximately 60 metres from the winning post and failed to regain its proper gait. Mr Knowles sought disqualification pursuant to R 1003.

Judge’s placings were 11, 7, 3, 2, 4, 5.

Mr Allison, stipendiary steward, demonstrated on the video that RUBY ‘N DIAMONDS, when leading, broke and continued in a gallop for a distance that was estimated to be between 60 to 80 metres.  The horse was still galloping when it crossed the finishing line.  Ms Hill, the driver and part-owner of RUBY ‘N DIAMONDS accepted this fact.

We are satisfied RUBY ‘N DIAMONDS galloped for some 80 metres and was still galloping as it crossed the line. The horse has failed promptly to regain its proper gait and, in these circumstances, we exercise our discretion to disqualify the horse pursuant to R 1003(2).

Amended placings are: 11, 3, 2, 4, 5.
