An information was filed by Mr. J M Muirhead alleging a breach of rule 869(3) (b), this information was lodged against Mr. I Brownlee the driver of Shezaclassact in race number one.

An information was filed by Mr. J M Muirhead alleging a breach of rule 869(3) (b), this information was lodged against Mr. I Brownlee the driver of Shezaclassact in race number one.
--Mr. Brownlee admitted the breach and did not wish to be present at the hearing.
--The information stated that horseman I Brownlee drove Shezaclassact carelessly racing into the fisrt bend causing interference to Girl Of Your dreams (P Jeffries) with resultant interference to Clovelly Beach (A White).
--Mr. Muirhead showed the video of the start of this race and identified the horses concerned, this video showed very clearly that Shezaclassact had come across and crowded Girl Of Your Dreams forcing this horse over the marker peg's, causing this horse to break and with Mr Jeffries having to take hold of his horse in doing so he caused a severe check to Clovelly Beach driven by Mr. White. These two horses Girl Of Your Dreams and Clovelly Beach were stopped in there tracks and virtually put out of the race. Mr. Muirhead stated to the committee that this interference was in the opinion of the Stipendiary Stewards at the top end of the scale. Mr. Muirhead produced the driving record of Mr. Brownlee which showed that Mr. Brownlee had been suspended on the 07/07/2005 for careless driving, and had been fined on the 06/10/05 for driving inside the marker peg's resulting in a $250,00 fine. Submissions on penalty were put forward by Mr. Muirhead and he requested a 3 day suspension of Mr. Brownlee's horseman's licence and a fine of $500.00. Mr. Muirhead also reminded the committee of the provisions of rule 1114, the status of the race on a premier night of racing.
----Decision and Reasons.
--Having taken into consideration Mr. Brownlee's admission of the breach of this rule the committee sought an explanation from Mr. Muirhead as to the request for a fine and a suspension in this instance. Mr Muirhead advised that a driver had been given a suspension and a fine the previous night at Cambridge. The committee also reviewed the penalties imposed over a considerable period and could only find three instances of a fine and a suspension for careless driving in a nine month period which did not include the Mr. Higgs case in the New Zealand Cup.
--Having taken all of these matters into consideration and wishing to not set a precedent this Judicial Committee imposed a suspension of Mr Brownlee's Horseman's licence up to and including the 31st December 2005 effectively 5 days.
--This committee found that the interference caused was severe and at the top end of the scale, and as a result of this carelessness by Mr. Brownlie two horses were denied there chance to compete for a premier stake. The committee also has taken into consideration the elements of rule 1114 in imposing this penalty.
