| -- DECISION AND REASONS: --Stipendiary Steward, Mr S Larkins, alleged the earplugs failed to release when the driver of QUIETLY FLYIN attempted to do so. The driver reported to Mr Larkins that the horse flicked his tail up and got it tangled with the earplug cord causing the failure to release the plugs. Mr Larkins stressed this is a strict liability rule. ----Mr Hokianga said the cord was always attached to the cart. It had been used for 12-13 starts with no problems but this time the wind blew the cord under the tail and the horse clamped it down causing the failure to release the earplugs. ----Mr Larkins said it was windy when the days racing commenced and said it was up to Mr Hokianga to adjust to the conditions. ----Mr Hokianga said if it was any tighter, the earplugs would come out. ----Decision: ----The charge was found proven. ----Submissions as to Penalty: ----Mr Hokianga had no previous charges under this rule. Mr Larkins asked for the standard $100 fine. Mr Hokianga felt no penalty was due. ----Penalty: ----Mr Hokianga was fined $100, and it was suggested that he contact another senior trainer at his home base, say Mr Ian Cameron, and seek advice as how to overcome this problem. -- |
