Following Race 9 an Information was filed pursuant to Rule 871(1) (D) by the informant Mr Coles.  He alleged that Mr Sasada allowed his mount Don Domingo to shift outwards near the 200 metres when not sufficiently clear of De Milo ( D Johnson) who was checked.

--

--

Mr Sasada pleaded guilty to the charge.

--

--

Mr Coles demonstrated the video films and showed that at approximately the 200 metre mark Mr Sasada, when riding his mount out with the whip, moved out and into the line of De Milo (D Johnson) when insufficiently clear of that runner.  He said Mr Sasada then straightened his mount and changed his whip but then shifted out again over several horse widths.

--

--

Mr Sasada said he did the best to straighten but it was not good enough.

PENALTY SUBMISSIONS

--

--

Mr Coles produced Mr Sasada’s record which showed he had a 4 day penalty on 16/8/08 (4 days).  He submitted this offence warranted a 4 day suspension. Mr Sasada said he had a firm commitment in the Manawatu Cup on 20/12/08.

--

PENALTY

--

--

The Committee carefully considered all submissions and before imposing a fair penalty took into account the following:

--

--
    --
  • Mr Sasada’s guilty plea
  • --
  • His excellent riding record
  • --
  • Level of carelessness and the subsequent check to Miss D Johnson
--

--

Accordingly we impose a suspension to start after racing on the 20/12/08 and conclude after racing on 28/12/08 (4 days). This takes into account a South Island day where Mr Sasada rides and a premier day at Ellerslie.
