Following Race 1 an information was filed instigating a protest pursuant to Rule 876(1) when it was alleged that COPPER SHOES placed first by the Judge, interfered with the chances of VIADUCT BELLE placed third by the Judge.

DECISION AND REASON:

--

Following Race 1 an information was filed instigating a protest pursuant to Rule 876(1) when it was alleged that COPPER SHOES placed first by the Judge, interfered with the chances of VIADUCT BELLE placed third by the Judge. This occurred in the final straight.

--

The distance between second and third was half a head.

--

All connections were advised of the protest.

--

Present at the hearing was Mr Baker, trainer of VIADUCT BELLE and its rider Lisa Cropp. Mr R Manning, trainer of COPPER SHOES, and rider Mr L Innes.

--

Mr Coles demonstrated the video films and showed Mr Innes on COPPER SHOES moving inwards and laying on and hampering VIADUCT BELLE on its inside.

--

Miss Cropp said that COPPER SHOES continued to lay in on her for some distance in the home straight hampering her progress which she believed definitely cost her second place.

--

Mr Baker agreed with Miss Cropp.

--

Mr Innes, rider of COPPER SHOES, admitted his horse moved in onto Miss Cropp which may have hampered her, however, he believed there was outward movement from VIADUCT BELLE which contributed to the tightening. He also said Miss Cropp did not stop riding.

--

Mr Manning agreed with Mr Innes saying that Miss Cropp had exaggerated the incident.

--

Mr Oatham said that Miss Cropp was hampered for a good distance down the straight and when considering the margin of half a head at the line he believed this cost VIADUCT BELLE a better placing. He said the protest should be upheld.

The Committee considered all evidence and repeated viewing the video films. It was clear there was:

  1. Interference suffered by VIADUCT BELLE when hampered by the inward movement of COPPER SHOES.
  2. --
  3. We believe that through this tightening suffered by VIADUCT BELLE its chances of finishing in a better place were affected.
  4. --
  5. In exercising our discretion we take into account the half-head margin between second and third at the post. We determined that if the hampering and tightening suffered by VIADUCT BELLE had not occurred Miss Cropp would have had her mount in a handier position.

Accordingly, the protest is upheld and the placings shall now be:
