This is an adjourned inquiry arising from race 9 at the Dargaville Racing Club meeting on 16 November 2007.

This inquiry comes pursuant to Rule 871(1)(d) when it was alleged by the Informant, Mr A Coles, that N Collett permitted her mount LUNCHCUTTER to shift inwards near the 150 metres when not sufficiently clear dictating TABULATE (M Sweeney) inwards crowding TUTORIAL (M Wenn) and CHIEF I ARE (K Hercock) who were checked.

Miss Collett denied the charge and was represented by her employer, trainer Mr R Collett.

Mr Oatham demonstrated the video films and showed that at approximately 150 metres from the finish Miss Collett riding LUNCHCUTTER shift in two horse widths when not the required distance clear of Mr Sweeney on her inside. He said the first shift was not the concern, but the second time Miss Collett kept riding forward and corrected her mount too late.

M Wenn was called as a witness being the rider of TUTORIAL. She said she was two or three horse widths off the fence when the outside horse ducked in sharply causing her to check. She could not verify whether Mr Sweeney, who was the cause of her check, received pressure from his outside.

M Sweeney rider of TABULATE said that at the 150 metre mark he was finishing fast when he received a little movement from the outside. He also said his mount was racing greenly and over-reacted to the movement from his outside. He said there was no contact between the two horses.

Mr R Collett, on behalf of N Collett, called Mr S Goodin, trainer of LUNCHCUTTER. Mr Goodin said this was the first time his horse had raced left-handed. He had a parrot mouth and had steering issues.

Mr R Otto, trainer of TABULATE, was called and said his instructions were to ride the horse cold, but conceded he did a lot wrong in the run to the line.

Mr R Collett said he did not believe Miss Collett was guilty of careless riding. He said the horse was green and asked the Committee to consider the inexperience of the horse involved.

Mr A Coles in summing up said the first inward movement was of no concern and agreed there were some mitigating circumstances. However, he believed that Miss Collett could have done more to straighten her mount in the second inward movement.

DECISION:

--

The Committee carefully considered all the evidence and reviewed the video films. While conceding there was some inward movement from Miss Collett we do not believe this was the sole reason for the interference.

We are clearly of the opinion that Mr Sweeney’s mount over-reacted to the slight inward movement of Miss Collett’s mount by ducking in sharply causing checks to the inside horses.

--

We believe the evidence of Mr Sweeney, M Wenn, S Goodin and R Otto all confirmed that greenness played a major part in the interference. Accordingly we believe there are enough mitigating factors to give Miss Collett the benefit of the doubt and dismiss the charge as presented.
