Following the running of Race 5 Mr. N.Harris lodged an information instigating a protest pursuant to the Rules of Racing alleging that Silver Treasure or its rider placed 1st by the judge interfered with the chances of Minkam placed 2nd by the judge



Following the running of Race 5 Mr. N.Harris lodged an information instigating a protest pursuant to the Rules of Racing alleging that Silver Treasure or its rider placed 1st by the judge interfered with the chances of Minkam placed 2nd by the judge. The interference occurred over the concluding stages.

The Judge’s placings were:

--

1st No.2 Silver Treasure

2nd No.10 Minkum

--

3rd No. 9 Miss Pee Gee Aye

4th No. 7 Plimsoll

5th No. 11 Indigenous

The margin between first and second was ¾ length.

The information was filed with the registrar within the time prescribed.

Present during the hearing were Mr Noel Harris and Mr D.Howarth representing Minkum and Mr. J.Parkes and Mr P.Belsham representing Silver Treasure.

Mr. Harris began by indicating on the films the clear run he had to the line with 100 metres to go. Soon after this point Mr Parkes, who was racing outside of him, began moving inwards on Silver Treasure taking the rightful line of Mr Harris forcing him to stop riding his mount out. Mr Harris had horses immediately on his inside which Silver Treasure was pushing him onto. Mr Harris said that Minkum was a lazy horse who needed riding out with the whip and he believed that the loss of momentum cost him at least one length at a vital stage of the race. He showed on the head-on film how Mr Parkes had drifted inwards approximately five horse-widths across his line of running.

Mr Howarth, the trainer of Minkum, told the committee that his horse had come from behind Silver Treasure and as Mr Parkes drifted inwards Mr Harris was forced to stand up in the saddle and stop riding two to three times which definitely cost him the race.

Mr Parkes acknowledged that he had run inwards but said that the interference was only a brush and he did not believe that Mr Harris would have beaten him.

Mr Belsham said Mr Harris had only lost a little momentum as a result of Silver Treasure moving across and that his horse had won comfortably as shown by the ¾ length margin.

The Stipendiary Steward, Mr Goodwin, stated that clearly interference had occurred however it was his opinion that with the margin between the two horses of ¾ length there was some doubt whether Mr Harris would have finished in a higher placing.

Decision

--

Rule 876 (1) requires us to ask first whether interference occurred and then, if so, whether that interference has cost the horse interfered with a chance of finishing in a better position.

--

We are satisfied having viewed the films and listening to the evidence that interference has occurred. Mr Parkes has quite clearly allowed Silver Treasure to move inwards taking the line of Minkum hampering that horse’s progress.

The committee then had to decide if the interference cost Minkum the chance of finishing in a better position.

--

Mr Harris was finishing strongly on Minkum until such time when Silver Treasure began his inward movement. This movement was considerable (five horse widths) and Mr Harris was forced to stop riding on three occasions. Had he not stopped riding he was in danger of pushing the two horses inside of him onto the running rail. Not only was Mr Harris denied his rightful line of running to the finish line he was also forced onto the shoulder of the horse immediately to his inside causing his mount to become unbalanced.

Taking into account Mr Harris’s inability to ride Minkum out with the whip, the momentum lost at a vital stage of a 2100metre race and the margin between the horses the committee upheld the protest and the amended placings now read:
