This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of THE OYSTER BAR driven by Mr S. Reid placed 4th against ALL DEFIANCE driven by Mr B. Mangos placed third on the grounds that ALL DEFIANCE was not in its correct gait when its nose reached the finishing line and was lapped on by THE OYSTER BAR.

This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of THE OYSTER BAR driven by Mr S. Reid placed 4th against ALL DEFIANCE driven by Mr B. Mangos placed third on the grounds that ALL DEFIANCE was not in its correct gait when its nose reached the finishing line and was lapped on by THE OYSTER BAR.

Mr G. Rogerson, part owner and co-trainer and Mr Mangos represented the connections of ALL DEFIANCE.  Mr Rogerson is also co-trainer of THE OYSTER BAR.

Mr Muirhead gave evidence of his observations of the finish of the race.  He said ALL DEFIANCE tripped short of the post and galloped across the line.  He viewed the race from just past the winning post.  He produced a photo of the finish of the race.  This shows that ALL DEFIANCE was not in its correct gait at the finishing line.  The photo also shows that ALL DEFIANCE was lapped on by THE OYSTER BAR, the official margin between the two horses being half a neck.  Mr Muirhead showed the video film of the finish of the race and said that in his opinion ALL DEFIANCE galloped across the line.  Stipendiary Steward Mr T. Taumanu also gave evidence.  He was standing with Mr Muirhead observing the race.  In his opinion ALL DEFIANCE galloped across the line.  That was also his interpretation of the video film.

Mr Mangos said that ALL DEFIANCE had tripped but was back in a pace on the line.  Mr Rogerson said that he believed both the photo of the finish and the video film showed that ALL DEFIANCE was pacing on the line.

Decision and Reasons:

--

The only question to be decided in this protest hearing is whether or not ALL DEFIANCE was in its correct gait when its nose reached the finishing line.  The committee is in no doubt whatsoever that both the video film and the photo of the finish show that ALL DEFIANCE was not in its correct gait when its nose reached the finishing line and was lapped on by THE OYSTER BAR.  The Committee accepts the evidence of Mr Muirhead and Mr Taumanu.  The rule is mandatory in that ALL DEFIANCE has to be relegated to behind THE OYSTER BAR.  The protest is upheld and ALL DEFIANCE is so relegated.  The final placings to be:

2nd – FRENCH FANTASY
3rd – THE OYSTER BAR
4th – ALL DEFIANCE
5th – ROCKET VENUS
6th - POWERTOFLY
