Decision:

DECISION AND REASON:

--

--

Stipendiary Steward Mr N Goodwin lodged an information alleging Mr James McDonald allowed his mount CLIFTON PRINCE  to shift in and crowd LIL’ MONSTER inwards which caused crowding to SHARP MELODY, CELTIC ROSE  and EBONY BABE which had to be checked near the 900m.

--

--

Mr McDonald, who was represented by Mr R Elliott, did not admit the breach.

--

--

Stipendiary Steward Mr N Goodwin read the rule.

--

--

Mr Goodwin demonstrated with the head and side on videos, which were shown from the 1100 metre start.  CLIFTON PRINCE (J McDonald) jumped from barrier 6 with a slight inwards movement and then straightened at approximately the 900 meter mark when angling for a run closer to the rail.  This tightened LIL’ MONSTER (barrier 4) causing a concertina effect onto SHARP MELODY (barrier 3), CELTIC ROSE (barrier 2) and checking EBONY BABE (barrier 1).  Ms Collet confirmed there was a tightening from the outside and received a severe check with contact from CELTIC ROSE.    MissV Johnston, Mr P Taylor and Mr R Jones confirmed of outside pressure and all riders called for relief from Mr McDonald.

--

--

Mr Elliot stated Mr McDonald has dictated the horses inside but not carelessly causing the interference, and felt Mr Taylor’s mount over-reacted, not maintaining enough speed to keep its position, causing the severe interference inside him.

--

--

Mr Goodwin stated Mr McDonald put pressure on the inside, pulled off and the second part of the interference leaves the horses on the inside nowhere to go.  The evidence from the witnesses and the films clearly show the pressure has come from Mr McDonald.

--

--

In reaching their decision the committee has clear evidence from the four witnesses which was confirmed on the video’s that Mr McDonald has moved across the line of which LIL’ MONSTER was entitled to.    This has caused that horse to start a concertina effect resulting in severe check to EBONY BABE four horses on the inside of CLIFTON PRINCE the mount of Mr McDonald.

--

--

The charge of careless riding is proven.

--

--

Penalty:

--

Mr Elliot stated that this was not intentional.  Mr McDonald has only been riding for five months and is trying his best.

--

--

Mr McDonald’s previous record consists of only one suspension.

--

--

In reaching their decision the committee has taken into account Mr McDonald is a young rider with a good record.  Whilst it may have been an error of judgement, this interference did affect four horses resulting in a severe check and the committee imposed a penalty of suspension from the conclusion of racing on 28th February 2008 until the close of racing on the 7th March 2008 (6 days)
