Following the running of Race 1 Horseman Mr DT McRae was charged with a breach of Rule 857(7)(g). Mr McRae pleaded not guilty to the charge.

DECISION AND REASON

--

Following the running of Race 1 Horseman Mr DT McRae was charged with a breach of Rule 857(7)(g). Mr McRae pleaded not guilty to the charge.

--

Stipendiary Steward Mr P Knowles used videos to illustrate his case. He stated that Mr McRae's horse, No.12, had drawn the (unruly 1) position, and should have started outside BUDS OF MAY, No.13, on the second line. Mr Knowles pointed out that when the field was released, Mr McRae's horse CASTLE ROYALE was approximately 3-4 lengths from its allocated position. This was clearly shown on the video.

Stipendiary Steward Mr C Allison used the video to show the same scenario.

Mr McRae, in his evidence maintained, that whilst he was some way behind the mobile he was, in his opinion, in the position allocated to him by the starter, namely, No.6 second line.

Starter, Mr Ward, gave evidence in that he had in fact instructed Mr McRae to start in the (U1) position, No.6 second line.

--

Mr McRae maintained that he had held his horse back (3-4 lengths) to miss the horses that he knew would break-up and affect his chances.

--

Mr Knowles in his summary pointed out that horsemen cannot choose their starting positions, also that a driver cannot choose his starting position (by predicting what may or may not happen at the start).

Mr Knowles also mentioned in his summary that if Mr McRae had started in the correct position, his horse might have finished in a better place. Mr McRae's horse (No.12) CASTLE ROYALE actually finished second, only half a length from the winner.

The charge was found proven. Before deciding penalty Mr Knowles produced a copy of Mr McRae's driving record for the past 12 months. There were 3 charges, 1 warning and 1 $100 fine for a similar offence. (11 Feb, 25 Feb & 24 Nov).

Taking the above record into account, a fine of $350 was imposed.
