| -- Margins: 2 ? --? length -- 1 ? lengths --Following the running of race one Jockey P Taylor (POROTENE WARRIOR) provisionally placed 4th by the judge protested against MAN OF FIRE (K Smith) provisionally placed 2nd by the judge alleging interference in the home straight. --Present Mr R Patterson (trainer) and Mrs A Herbert (trainer) --Jockey P Taylor told the committee that in the run to the winning post his mount was travelling well. He had ample room. He was never going to pick up the winner but felt he would comfortably run third. --Jockey K Smith's mount travelling on his outside then ducked in and Jockey Taylor had to change ground to continue his run. He felt he could have easily clipped heels and the momentum that he lost cost him from at least running third. With the aid of both available films he pointed out to the committee Smith's mount's sudden inward movement and his changing of the ground to mount his run. --Jockey K Smith agreed his horse did duck in. He felt though he was marginally clear. He also told the committee that Jockey P Taylor did not stop riding his horse at the point of the alleged incident and certainly did not take hold. --Mrs A Herbert (trainer) told the committee that the horse did duck in but no contact was made. She felt that Jockey Taylor's mount was not gaining ground and doubted that he would have run 3rd. --Stipendiary Steward Mr N Goodwin informed the committee that POROTENE WARRIOR did move inwards but he doubted, that even although he had to change ground, whether Jockey Taylor's mount was travelling well enough to finish in a higher placing. --DECISION AND REASONS ----Rule 876(1) requires the committee to consider a number of issues pertaining to this protest. --Firstly did interference occur and if so whether that interference cost the horse interfered with from finishing in a higher placing. --The available films clearly showed the inward movement by MAN OF FIRE. --POROTENE WARRIOR did have to be pulled out and around to mount its run. --The committee concurred that Jockey Taylor did not take hold or stop riding at the point of the alleged incident. --Even though POROTENE WARRIOR was running on the committee was not convinced that the incident cost the horse a chance of finishing in a higher position. --The protest was dismissed and placings were allowed to stand. ---- -- -- -- --
