Following the running of Race 3 an information was lodged by Stipendiary Steward Mr S. T. Larkins against Mr C. J. De Fillipi alleging a breach of Rule 867 in that Mr De Fillipi drove Fleet Magic for a considerable distance with his right foot out of the sulky rest.
| -- DECISION AND REASONS: --Following the running of Race 3 an information was lodged by Stipendiary Steward Mr S. T. Larkins against Mr C. J. De Fillipi alleging a breach of Rule 867 in that Mr De Fillipi drove Fleet Magic for a considerable distance with his right foot out of the sulky rest. Mr De Fillipi had indicated on the Information that he admitted the breach of this rule and he confirmed this at the hearing. --Mr Larkins showed video coverage of this incident. --Mr De Fillipi explained that he committed this breach "unconsciously" when he was trying to drive his horse to best advantage. --PENALTY: Mr Larkins advised that Mr De Fillipi had no previous convictions for a similar offence. Mr Larkins pointed out that this was Group 2 race with a stake of $50,000 and recommended a fine of $200-00. Mr De Fillipi said that he thought that the fine suggested was too high. --We adjourned to consider the question of penalty. --We found that previous fines for a breach of Rule 867 ranged between $50-00 and $300-00, although we were unaware of the circumstances of these breaches. --In coming to our decision on penalty we have taken into account Mr De Fillipi's frank admission of the breach and his clear record. We have also taken into account the status of the race and the stake payable. --Taking all the above matters into account we considered that a fine of $150-00 was appropriate and Mr De Fillipi was fined this amount. ---- -- ----
