A second information lodging a protest into Race 10 of the Bay Of Plenty HRC meeting was heard.  The information alleged that Beach Buggy had caused interference to Captain Gibbs with approximately 350 metres to run

Present for the hearing were stipendiary stewards Taumanu Muirhead and Wallis.  Miss Chilcott appeared for the connections of Captain Gibbs and Junior Driver Z Butcher for Beach Buggy supported by senior horseman Mr D Butcher.

Mr Muirhead identified the respective horses with Miss Chilcott four back on the running line and Mr Butcher sitting in the one out one back position coming into the final turn for the run home.

--

As they approached the turn looking to make runs Mr Butcher moved three wide looking to go around Buller.  At the same time Miss Chilcott came off the running line and moved out to follow him into the three wide position.  Mr Butcher’s horse broke for a few strides and Miss Chilcott had to pull back off its back and switched inside behind the slowing Buller to avoid being checked by the galloping Beach Buggy.

After changing ground inwards and moving into a pocket Miss Chilcott then had to pull back extract herself and come right out finishing strongly  a length behind the winner Mr Butchers horse.

Miss Chilcott agreed with the Stipendiary Stewards assessment.  She was angling onto Mr Butchers back when his horse broke. She wasn’t to know he would recover quickly and had to take evasive action onto the back of a horse that was tiring.  It had cost her a lot of momentum as she virtually had to pull up then had to drag right across the field to get a run. The actions of Beach Buggy she believed cost her good chance of winning or of at least finishing in a higher place. In the last 100 metres she had made huge ground on the field and if she had been able to follow Beach Buggy out as intended could have started her charge home a lot earlier.

Mr D Butcher suggested that Miss Chilcott was not on the back of Beach Buggy when the horse broke but more on his inside wheel about half way out.  When the horse had gone rough there were two horses outside and Miss Chilcott had nowhere to go anyway.  She still had to wait so when they had run on with Beach Buggy being the winner Miss Chilcott had angled across and got the run she would have got anyway.  To say that the interference cost her chance of winning was incorrect.

Decision and reasons

--

The Committee was satisfied that Beach Buggy had caused interference when it broke and checked Captain Gibbs.  In breaking Beach Buggy had also moved in about half a cart further impeding her progress.

We were satisfied that Miss Chilcott’s horse being full of running was destined to finish strongly and as a result its chances were affected

--

 

--

Accordingly the protest is upheld and Beach Buggy is relegated to finish directly behind Captain Gibbs.
