Decision: An Information was lodged by Stipendiary Steward Mr TW Taumanu against horseman MW McKendry, alleging that Mr McKendry failed to ensure that any part of the sulky of BROOKFIELD ATOM did not protrude inside the marker line as it did happen over the final 60 metres of the race

An Information was lodged by Stipendiary Steward Mr TW Taumanu against horseman MW McKendry, alleging that Mr McKendry failed to ensure that any part of the sulky of BROOKFIELD ATOM did not protrude inside the marker line as it did happen over the final 60 metres of the race.

By agreement, the evidence taken at the protest hearing into the placing of BROOKFIELD ATOM was accepted as evidence in respect of this information.  The video films of the incident were however looked at again and available to both parties.

Mr Taumanu pointed out that Mr McKendry was never up into the gap inside UNDER MY THUMB and that there was insufficient room.

Mr McKendry again stated that prior to moving into the gap, he had wound his horse up and he could not pull it out of the gap in time.

In respect to penalty, Mr Taumanu suggested a fine of $250.00 and Mr McKendry thought that that was ridiculous.

I again assessed the evidence and took the opportunity to again view the films on numerous occasions and I viewed Mr McKendry's attempts to pull out of the gap that he had attempted to move into.  I find as a matter of fact that Mr McKendry had used the whip on his horse at least twice after he had moved over the first pylon and possibly the second and, accordingly, if Mr McKendry had made an attempt to pull out of the gab, then he did so too late.

I find the charge proven and impose a fine of $200.00.
