The said rule was read and understood by Mr McGlinchey.

The Facts
Mr Oatham in his presentation stated Mr McGlinchey has only had a handful of rides in New Zealand prior to riding in England and Ireland.

Mr Oatham then proceeded with his interpretation on the films available being the head and side versions. The Stewards allege Mr McGlinchey failed to ride his mount out to the finish of the race and believe ‘Secret Stone’ had a reasonable chance of finishing in third place with the margin half a head beaten into 4th place.

Mr Oatham gave his interpretation using the head and side on films where early in the home straight. Mr McGlinchey on ‘Secret Stone’ was using the whip and momentarily may have got to the front. He continues to ride his horse out pushing forward puts the whip away and at a point approximately three to four strides from the finish line he relaxes his ride and stands in the saddle and is beaten by half a head into third by the horse ridden right to the line on his outside.

Mr McGlinchey using the films to show and explain where ‘Secret Stone’ has come back very quickly, came to the end of his run, he has gone from travelling to in one stride he had stopped. Mr McGlinchey also stated he has possibly layed off him a little bit.

Summarising Mr Oatham stated the films clearly show Mr McGlinchey did not ride his horse out to the finish which he is obligated to do so under the rule. The betting public and connections of the horse can expect Mr McGlinchey to fulfil those obligations so we know where the horse will finish. It is clear he stopped riding three to four strides short of the finish and the margin of half a head he had a reasonable chance of finishing third.

Decision on charge
Having viewed the films and considered the evidence before it the committee have to consider did Mr McGlinchey give his mount ‘Secret Stone’ every reasonable chance in this instance of finishing third. It is clear from both the head and side on films that Mr McGlinchey has dramatically changed his riding style over the concluding stages of the race; he does relax in his riding, and stands in the saddle three to four strides short of the post. Mr McGlinchey also admitted that he “possibly layed off him a little bit” and therefore has not given his mount a reasonable chance as required under the Rule 866(1) (c).

The charge is proven.

Submission on Penalty
Mr Oatham said Mr McGlinchey has a clean record; however this did involve a dividend bearing place, as well as the betting public and the connections. A term of suspension is warranted. The term sought would be in the three to four week range.

Mr McGlinchey appealed for leniency from the committee and felt three to four weeks is harsh for a simple mistake.

Before imposing a penalty the committee have considered all the evidence and have taken into account.

On this occasion we impose a term of suspension from the close of racing 27th June up to and including Sunday 19th July. (Three weeks).
