Following the running of Race 6, the DHL Global Forwarding Premier1600 metres, Ms K. Myers was charged with a breach of Rule 871 (1) (d), careless riding.

Following the running of Race 6, the DHL Global Forwarding Premier1600 metres, Ms K. Myers was charged with a breach of Rule 871 (1) (d), careless riding.
--The information alleged that K. Myers permitted her mount (CAN’T KEEPER DOWN) to shift inwards near the 300m when not clear of GO DANNY (J. Waddell) who was checked.
--Ms Myers admitted the breach.
--Video footage of the incident was played which showed Ms Myers two-wide off the fence with GO DANNY on her inside. Ms Myers then shifted inwards approximately one horse-width which moved her into the rightful line of running of GO DANNY who was forced to check.
--Rear views of the incident clearly confirmed the inward movement made by Ms Myers and a side-on view showed that she was never sufficiently clear of Mr. Waddell when she moved inwards.
--An additional view from the 800m tower confirmed Mr. Waddell’s position prior to the interference which was well up inside the mount of Ms Myers.
--Ms Myers admitted taking the line of GO DANNY but said that at the time she had thought she was clear and that she had left him well behind. In her opinion it was marginal and the interference minimal.
--Mr. Oatham said that Ms K. Myer’s record showed only one charge of careless riding in the previous 12 months. This was at Foxton on 1/6/09 where she was suspended for four days. He said that this incident was in the mid-range and had effectively extinguished Mr. Waddell’s chances in a $30,000 race. When asked to elaborate on this comment he told the committee that was his own opinion. Mr. Waddell had said that while he had been affected he was never going to finish in the first three.
--The Stewards’ submission was for a suspension in the vicinity of five to seven days.
--Ms Myers reiterated that she thought the interference was minimal and told the committee that Mr. Waddell had said that if she had been a few more strides on he wouldn’t have been affected at all. She also advised of no confirmed riding engagements within the next seven days so any suspension could begin immediately.
--Penalty
--In coming to a decision on penalty the committee had regard to all of the submissions put before it. We took into account Ms Myer’s admission of the breach and her excellent riding record. In considering the degree of interference it was the opinion of the committee that it was in the mid to low range. Mr. Oatham said that Mr. Waddell’s chances had been extinguished and Ms Myers said the interference was minimal. We believe that it lies somewhere between these views. In considering the degree of interference we also looked at how many horses were affected- in this case only one.
As required by the Rules of Racing we have also taken into account the stake of the race.
Ms Myers is suspended from riding from the conclusion of racing today Saturday October 3rd 2009 until the conclusion of racing on Wednesday October 14th 2009 which is in effect 5 days.
