When racing around the final bend Mr Keats allowed his horse STORMY LOCH to strike the sulky wheel of PERFECT PROMISE, which caused his horse to briefly break from its gait.
Mr McIntyre had Mr Renault demonstrate that with approximately 400 metres to run, and when travelling behind Mr McCormick, whose horse appeared to be tiring, the near front leg of Mr Keats’ horse struck the outside wheel of Mr McCormick’s cart as Mr Keats was attempting to clear the tiring runner.
Mr Keats admitted the breach and indicated he did not wish to appear at the hearing.

Mr McIntyre produced Mr Keats’ record, which was clear under this rule this year. He said the breach was at the bottom end and submitted a fine of $200 was appropriate.

We find that the breach is at the bottom end of the scale of careless driving. Mr Keats has miscalculated when endeavouring to improve past a tiring runner. Mr Keats’ actions inconvenienced no other runner and his horse, which was racing near the rear of the field, galloped only briefly.
Mr Keats’ has a very good record and has readily admitted the breach.

We believe a fine of $200 is sufficient to hold Mr Keats accountable on this occasion.
