Following the running of Race 7, the Clark Boyce Lawyers Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Miss M. R. McIntyre, driver of "Suzys Delight" (5), alleging a breach of Rule 869(3)(b).

DECISION AND REASONS:
--Following the running of Race 7, the Clark Boyce Lawyers Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Miss M. R. McIntyre, driver of "Suzys Delight" (5), alleging a breach of Rule 869(3)(b). The charge was that Miss McIntyre drove carelessly round the final bend when allowing her horse to move inwards causing interference to "Lady Bess".
--Miss McIntyre confirmed at the hearing that she admitted this breach of the Rules, and that she understood the Rule and the charge.
--The full details of this incident are set out in the decision relating to the disqualification of "Suzys Delight". The evidence from that hearing was accepted for the purposes of this hearing.
--Penalty: In relation to penalty Mr Escott advised that Miss McIntyre had no previous convictions and that her guilty plea should be taken into account. Miss McIntyre said that she would prefer a suspension to a fine and Mr Escott recommended a suspension of four days.
--It was also established that Miss McIntyre had no definite drives in the near future, but that it was possible that drives might be available to her over the suggested period of her suspension.
--After hearing the parties in relation to penalty I was satisfied that a four days suspension was appropriate in this case. The suspension is to commence after the completion of racing on 24 August 2007 and is to end after the completion of racing on 9 September 2007.
