Following the running of race No.3 an information was filed alleging a breach of Rule 869(2)(A).  The informant was Mr. J.M.Muirhead and the defendant Mr.B.Lee.

The information alleged that Horseman Mr.B.Lee used his whip excessively

Following the running of race No.3 an information was filed alleging a breach of Rule 869(2)(A). The informant was Mr J.M.Muirhead and the defendant Mr.B.Lee.

The information alleged that Horseman Mr.B.Lee used his whip excessively over the concluding stages driving SANDPARK SIDNEY.

Mr Lee signed the information admitting the breach of this rule and also signed that he did not wish to appear at the hearing of this information.

Mr Muirhead  showed the video of the run home and this clearly showed SANDPARK SIDNEY under a drive by Mr Lee in the run to the winning post.  The video clearly showed Mr Lee striking SANDPARK SIDNEY on several occasions with no pause in his whip action as per the regulations for the use of the whip.

Mr Muirhead stated that this was against the regulations for the use of the whip and considering Mr Lee had been charged with unnecessary use of the whip on the 25th July 2008 and fined $300.00 Mr  Muirhead was very disappointed in the actions of Mr Lee on this occasion.

Mr Muirhead produced Mr Lee’s driving record for perusal and asked for a suspension of Mr Lee’s horseman,s  licence for a period of two weeks.

Decision And Reasons.

Having taken into consideration the fact that Mr Lee has admitted the breach of this rule in this instance, I have to be mindful of the fact Mr Lee was charged with unnecessary use of the whip only seven days ago.   On that occasion Mr Lee was fined $300.00 and warned that if he was to appear on a similar charge a suspension of his licence would be imposed .

It is obvious that Mr Lee has not  taken notice of this warning and a suspension of Mr. Lee’s horsemans licence is ordered  to and including the 21st August 2008.
