Prior to race 7 an information was filed pursuant to Rule 828(1)(2) when it was alleged by the informant, Mr J Oatham, that Mr W Pomare failed to scratch JOE KING, which was a dual acceptor, by the required time of 7.30 am

Prior to race 7 an information was filed pursuant to Rule 828(1)(2) when it was alleged by the informant, Mr J Oatham, that Mr W Pomare failed to scratch JOE KING, which was a dual acceptor, by the required time of 7.30 am The horse was eventually scratched from race 7 at approximately 9.30 am.

Mr Pomare pleaded guilty to the charge.

Mr Oatham said Mr Pomare left his horse in two races and made no attempt to scratch his horse from one race by the required time. The Club made every endeavour to contact Mr Pomare to ascertain which race he wanted to scratch from and could not do so until 9.30 am when Mr Pomare instructed them to scratch JOE KING from race 7.

Mr Pomare said he had not contacted the Club by the required time because he presumed they would automatically scratch the horse from race 7 when it made the field in the other race. This had happened in the past he said.

PENALTY:

Mr Oatham said that punters were affected by Mr Pomare's actions, but believed that the penalty could be covered by way of a fine.

The Committee considered all submissions and took into account Mr Pomare's guilty plea.

--

In delivering our penalty we pointed out to Mr Pomare that it is his obligation to scratch the horse and no-one else's. Accordingly we impose a fine of $150.
