Chief Stipendiary Steward, Mr LN McCutcheon, lodged an information under Rule 707(1)(d) Request for a Ruling, asking for a ruling that the horse COURTINTHEVALLEY be declared a non-runner in race 7 due to injuries suffered in the barrier.
----Mr McCutcheon demonstrated the head-on film and explained to the committee his observation from the TV monitor of the horse COURTINTHEVALLEY in barrier three at the start, rearing, getting his near front leg over and jamming it between the gate and the framework. The horse eventually broke free through the front gate and was visibly lame and gave the appearance of being tender. COURTINTHEVALLEY was then led behind the stalls and remounted. Mr McCutcheon, at this point, fearing those behind the starting stalls may not have seen the leg caught tried to contact Mr French, the Starter. No contact was made and the horse took his place in the barrier and started in the race. COURTINTHEVALLEY finished second to last and when it returned to the birdcage was observed to have abrasions to the leg and was lame. Stipendiary Steward Mr McCutcheon, felt in fairness to all parties, especially the connections and the punters that the horse COURTINTHEVALLEY should not have started and therefore a request for a ruling is sought to have COURTINTHEVALLEY declared a non-starter.
----The committee, after viewing the film and hearing the evidence presented, support the submissions presented, the horse was possibly not given the opportunity to run on its merit and the punters were not accorded an equal opportunity with their investment, also the well being of the horse must be addressed. The committee are concerned a horse injured to this extent was cleared to start.
----The committee upheld the request and declared COURTINTHEVALLEY shall be a non-runner in race seven "The Waterfront Hotel 1600."
