Evidence:
Following the running of Race 8, the Dominator Doors Maiden Mile, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class A Rider, Miss A Collett, alleging careless riding near the 200m, in that she angled her mount, LADY DAVONE, outwards when not sufficiently clear of LEULUAI which checked when forced outwards onto PENDLELTON.

Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”

Miss Collett had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Mr Collett also agreed that she understood the charge and the Rule it was brought under.

 

Submissions for Decision:
Mr McLaughlin, with the assistance of Chief Stipendiary Steward, Mr J Oatham, gave evidence and used video coverage to show that shortly after turning for home and near the 200m, LADY DAVONE, ridden by Miss Collett, was racing in a one-off position behind the leading horses with LEULUAI, ridden by Mr R Cuneen on the outside of Miss Collett with PENDLETON, ridden by Miss S Collett on the outside of LEULUAI. On the head on replay, Mr Oatham pointed out that there was clearly no run available for Miss A Collett. He stated that Miss Collett shifted out and forced LEULUAI out onto PENDLETON buffeting and unbalancing LEULUAI for several strides. Mr Oatham stated that it was clear on the films that Miss Collett had turned her horse’s head out and angled her mount out quite abruptly forcing a run on the outside of LEULUAI, when not entitled to do so.

Miss Collett conceded that she had ridden carelessly but stated that it was very windy during the running of the race. She said that as she was coming out the horse in front of her rolled out a fraction and she had to take action to clear its heels. Miss Collett stated that she shifted out fractionally further than she should have due to her horse overreacting and after that “wish washed” over the final stages due to the windy conditions.

 

Reasons for Decision:
As Miss Collett had admitted the breach, the charge was found proved.

Submissions on Penalty:
Mr McLaughlin stated that Miss Collett’s penalty record showed 4 breaches of this rule since December 2016 being 4 days at Riccarton on 2 December 2016, 5 days at Wellington on 21 January 2017, 4 days at Avondale on 22 February and 4 days at Waikato on 20 September. He stated that Miss Collett was a very busy rider who rode in all districts and was considered a national rider.

Mr Oatham stated that Miss Collett’s statistics showed she rode in 830 races last season. He submitted that the breach was mid-range and a term of suspension around 5 days be considered as penalty.

Miss Collett stated that she was required to be competitive and give her mounts every chance to win the race. She said that if she had sat and waited for a run she would have been questioned about her ride. She conceded that she was careless but that it was also competitive riding and submitted that the level of the breach was at a lower level than mid-range. Miss Collett said that PROM QUEEN was racing at Ashburton on 21 October and hoped she would be able to fulfil her engagement with that horse. She submitted that a suspension and fine be considered as penalty.

Mr McLaughlin stated to the Committee that the Stewards would not support a mixed penalty of a suspension and a fine.

Deferment was discussed with Miss Collett who requested that any suspension begin as soon as practically possible.

 

Reasons for Penalty:
The JCA Penalty Guide for a mid-range breach of this rule for a National rider is a 5-day suspension. The Committee agreed with the Stewards that this was a mid-range breach so therefore no uplift in starting point was required. Miss Collett’s record shows 4 breaches of this rule over the previous 12 months, the most recent on 20 September and before that approximately 8 months prior on 22 February 2017. Due to the large number of rides over the previous 12 months we were prepared to consider Miss Collett’s record as neutral. We therefore determined that there were no aggravating factors in this case to warrant an uplift in penalty. Miss Collett’s’ submission for a suspension and a fine were dismissed as there were no exceptional circumstances to warrant consideration of a “tailor” made penalty.

Adopting the JCA Penalty Guide starting point of a 5-day suspension we were able to afford Miss Collett a discount for her admission of the breach. This we set at 1 day. We therefore determined that a 4-day suspension was an appropriate penalty.

 

Penalty:

Accordingly, Miss Collett’s Class A Jockeys licence was suspended from the conclusion of racing 15 October up to and including 21 October 2017.

This suspension encompasses the meetings at Te Aroha on 18 October, Woodville on 19 October, Tauranga on 20 October and Rotorua or Ashburton on 21 October 2017.
