An information lodged by Stipendiary Steward Mr J Muirhead against Mr W Thomas driver of WINMILL alleging a breach of Rule 869 (2) (a) - Excessive Use of the Whip - in that he used his whip excessively on his horse over the concluding stages of the race.

--Mr Thomas admitted the breach and did not wish to be present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. Mr Thomas struck his horse with the whip on about 230 occasions in the home straight, some of them being solid blows. Mr Muirhead said that Mr Thomas had explained that the trainer of the horse had told him that the horse needed to be hit with the whip to do its best.

PENALTY
--Mr Muirhead said that Mr Thomas had no relevant breaches of the rules reported against him. He suggested a fine of $250.00. In fixing penalty I took into account the following :

- The guilty plea, although this was somewhat inevitable. --
- Mr Thomas' clear driving record. --
- The offending was mid point on the scale of seriousness. --
- The submissions of Mr Muirhead.
Balancing those matters I imposed a fine of $250.00
