FACTS:

--

Following the running of Race 4 Ms V. Johnson  admitted a charge of excessive use of the whip brought under Rule 638 (3) (b).

The Information alleged that V.Johnson being the rider of HI FLO excessively used her whip between the 400 and 200 metres.

--

 

--

Mr Goodwin showed the head-on view of the race from the top of the home straight until the finish.  Ms Johnson, who was racing in the widest position on the track, hit her mount between 12 and 15 times prior to the 200 metre mark which was well outside of the NZTR whip guidelines.

The guidelines are that once a horse enters the final straight it can be hit with the drawn whip up to six times and then a rider should ride hands and heels for six strides before hitting the horse again with the drawn whip and continue until the 200 m.

From this point on a rider may use the drawn whip continuously to the winning post if the horse is holding its position or improving.”

Ms Johnson agreed that she had ridden outside of these guidelines but put the number of times she used the whip at 12.

SUBMISSIONS:

Mr Davidson said that Ms Johnson had never been charged with excessive use of the whip before and the Stewards’ considered this breach to be at the lower end of the scale.

He said that recent penalties had ranged from $200 fines up to $1000 fines. 

--

Ms Johnson asked the committee to take into account her record and that she believed she hit her horse 12 times not 15.

--

DECISIONS and REASONS:

--

In coming to a decision on penalty the committee took into account Ms Johnson’s admission of the breach, her excellent record and the number of times that she hit her mount which we counted at 12. We also looked at the manner in which the whip was used with the films showing HI FLO responding to the Ms Johnson’s efforts.

--

It was our opinion that the breach was towards the lower end and balancing all of these factors we impose a monetary penalty of $200.
