Information 5088 alleges that J Waddell allowed his mount to shift out when not clear of Tommie over the final stages, resulting in interference to that runner.
Information 5088 alleges that J Waddell allowed his mount to shift out when not clear of Tommie over the final stages, resulting in interference to that runner. Mr Waddell admitted the breach, was present at the hearing and was represented by Licensed Jockey R Hannam.
----The rule was read and both Mr Waddell and Mr Hannam acknowledged they understood same.
----Mr Goodwin then demonstrated head on and side on films of the alleged incident. It was his view that Mr Waddell had continued to ride his horse with vigour when it was on an outward movement of approximately 3 to 4 horse widths, he was also of the view that Mr Waddell had the opportunity to check and straighten his mount.
----Mr Hannam on Mr Waddell's behalf felt Mr Waddell may have not seen Mr Herd's mount and said Mr Herd should have called to him (Mr Waddell).
----Mr Goodwin then gave the committee Mr Waddell's record which showed he was suspended for 3 days at Te Rapa on the 17 December 2005.
----The Chairman asked Mr Waddell how long he had been back in New Zealand, he stated approximately 2 months.
----Mr Goodwin then made submissions as to penalty, it was his view that the incident was not of a minor nature and that the horse had moved out to 3 to 4 horse widths whilst under a ride, had taken the line of another horse and caused that horse to clip heals. This action had also caused a change of placings and this effected punters. It was his view a term of suspension was warranted.
----Mr Waddell for his part told the Committee prior to the December 05 suspension he had not been changed since December o4 either here or overseas and felt this was a very good record.
----He also asked could he be suspended for say 2 days and be fined a substantial sum, as he had a good book of rides for Saturday the 21st at Wellington.
----Mr Hannam also suggested 2 days and a substantial fine would be appreciated.
----When arriving at a penalty the Committee took into account Mr Waddell's admission of the breach and also considered he and Mr Hannam's submissions as to penalty.
----They were of the view however that the breach was not of a minor nature ? had caused a change of placings and also had the potential to be dangerous and therefore warranted a term of suspension. Mr Waddell may ride at Awapuni on the 14th of January and is then suspended from riding until the conclusion of racing on January 21st in effect 3 days.
