An information was filed alleging a breach of rule 869 (3) (b) the informant was Mr. T W Taumanu and the defendant Mr. P C Ferguson. The information stated that Mr. P C Ferguson drove carelessly when he moved Summer Man out quickly to improve causing a check to Nacokee which broke as a result, with approximately 150 meters to run.
--Mr. Ferguson admitted the breach of this rule and was present at the hearing of this information.
--Submissions were heard on penalty from Mr. Taumanu. Mr. Taumanu did not seek a suspension and asked for a fine, the driving record of Mr. Ferguson was produced and this showed only one breach of the rules back in September last year. Mr. Taumanu stated Mr. Ferguson had a very clean driving record.
--Mr.Ferguson when asked for his submissions on penalty stated he wished to bring up some mitigating factors and wished to call Mr. Messina the owner of Summer Man who gave evidence that on returning to the stabling area Mr.Ferguson advised that he could not steer Summer Man and Summer Man had given him a difficult drive.
--Mr. Ferguson also wished the committee to view the video again and he pointed out where Summer Man had hung inwards badly during the running of this race.
