Following Race 7 an information was laid against Ms LK Cropp, alleging a breach of Rule 871(1)(d) in that she shifted outwards on KAYS AWAKE, No.10, into the rightful line of running of GEE I JANE, No.5, ridden by Mr L Innes, when not sufficiently clear of that runner.

DECISION AND REASON:

--

Following Race 7 an information was laid against Ms LK Cropp, alleging a breach of Rule 871(1)(d) in that she shifted outwards on KAYS AWAKE, No.10, into the rightful line of running of GEE I JANE, No.5, ridden by Mr L Innes, when not sufficiently clear of that runner.

Ms LK Cropp acknowledged she understood the charge and denied the alleged breach.

Evidence:

--

Mr A Coles, Stipendiary Steward, gave evidence and demonstrated on the race videos (head-on and side-on) his interpretation of the incident. He said that KAYS AWAKE, No.10, ridden by Ms LK Cropp, shifted outwards into the rightful line of running of GEE I JANE, No.5, ridden by Mr L Innes when not sufficiently clear of that runner. He was not challenged on his evidence. Mr Coles' evidence corroborated Jockey L Innes' evidence.

Mr L Innes, rider of GEE I JANE, No.5, gave evidence that he was half way down the straight, he said Ms LK Cropp took his line for about 8-10 strides. He said he suffered severe interference, he believed it cost him winning of the race.

Ms LK Cropp gave evidence and demonstrated her interpretation of the alleged incident. She said there was inward and outward pressure from horses. She denied she moved out herself. She said VAALU pushed her out from the outside. She submitted that her riding was not careless.

--

The Committee preferred the evidence of Mr L Innes (rider of GEE I JANE) and Mr A Coles.

--

The Committee found the charge of careless riding proven.

--

Result:

The charge of careless riding (Rule 871(1)(d)) has been proved. Ms LK Cropp allowed her mount to shift out when not clear of GEE I JANE (L Innes).

Penalty:

--

After hearing submissions on penalty from Mr LN McCutcheon and Ms LK Cropp, the Committee determined that a suspension must be imposed.

--

Mr McCutcheon submitted a three-week suspension should be imposed.

--

Taking into account the following factors:

--

That Race 7 the ?Darley Plate? was a Group Three status race.

Rule 1122(2) provides:

--

" On find a breach proved the Judicial Committee MAY impose any penalty, provided by these rules. In imposing a penalty provided in these rules the Judicial Committee may have regard to such matters as they consider appropriate including ?

    1. the status of the race
    2. --
    3. the stake payable in respect of the race
    4. --
    5. any consequential affects upon any person or horse as a result of the breach of the rule.

GEE I JANE suffered significant interference and this was a Group Three race. Mr L Innes believed he would have won the race but for the interference.

The Committee considered Ms Cropp's prior riding record which is not particularly good, given that there was a six-day suspension in January 2006 and four other suspensions for careless riding in 2005. The Committee acknowledged that Ms Cropp rode in both the North Island and the South Island (high number or rides).

During submissions on penalty Ms Cropp raised for the first time that the trainer of KAYS AWAKE had reported the horse had pulled up lame and that the trainer had a vet certificate. Ms Cropp said that she felt it go just short of the post and nearly lost her balance. She suggested that may have contributed to the earlier incident.

The Committee said they had taken that into account but still found that there was careless riding. Accordingly, Ms Cropp's jockey's licence is suspended from the conclusion of racing on the 8 March 2006, up to and including the 22 March 2006 (two weeks),

In fixing the period of suspension the Committee have taken into account that Ms Cropp will miss a premier race meeting at Ellerslie on 11 March 2006, including Group rides. In the circumstances the Committee said they were not prepared to defer the suspension.
