Decision:

Following the running of Race 4, Forbury Function Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against BAND ON THE RUN, placed 1st by the judge, on the grounds of interference in that “with approximately 1200 metres [sic] BAND ON THE RUN struck the sulky of TELEMECANIQUE resulting in checks to several runners”.

Following the running of Race 4, Forbury Function Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against BAND ON THE RUN, placed 1st by the judge, on the grounds of interference in that “with approximately 1200 metres [sic] BAND ON THE RUN struck the sulky of TELEMECANIQUE resulting in checks to several runners”.

Mr C T Dalgety, trainer of BAND ON THE RUN, was present at the hearing of the protest and indicated that he represented the connections of BAND ON THE RUN.

Mrs Williams said that the Steward was alleging that Mr D J Dunn was the driver of BAND ON THE RUN, which was in the trail behind TELEMECANIQUE (M P Jones). Mr Dunn allowed his horse to travel too closely to TELEMECANIQUE resulting in it striking the back of the cart of that runner with approximately 1200 metres to run. TELEMECANIQUE broke and, as a result, the trailing runners on the outside had to take evasive action. In particular, MISTER GNP (K M Barron) broke which resulted in interference to ALLERGEE (P J Davis) and to PERAKI KING (J C Hay) which was pulled up and retired from the Race. Mrs Williams said that the Stewards were seeking disqualification of BAND ON THE RUN.

Mr N G McIntyre showed video relays of the incident with approximately 1200 metres to run. He showed that BAND ON THE RUN, racing in the trail, came into contact with the cart of the leader, TELEMECANIQUE, which it had been trailing. The contact was apparent from the way in which Mr Jones reacted. The contact was “heavy” and it put TELEMECANIQUE off stride. He showed that several trailing runners, including MISTER GNP, took evasive action and PERAKI KING broke and lose its chance. TELEMECANIQUE was almost brought to a standstill by the contact, he said.

Mr Jones said that the contact he received “jolted” his cart. He was not aware of the interference to the following runners. He lost some ground as a result of breaking but his horse “got back pacing” and settled in the 1/1. He said that his horse would not have broken had its sulky not been struck from behind.

Mr Barron said that he saw TELEMECANIQUE gallop ahead of him. His own horse, MISTER GNP, could not cope with the “backwash”. It “ricocheted” off the cart of the runner in front. Prior to the interference, his horse had been in a “good spot” and lost 3-4 lengths and the good position as a result of the interference. The Committee noted that MISTER GNP finished 4th in the Race, 3¾ lengths from the winner.

Mr Jones confirmed, when asked by Mr Dalgety, that TELEMECANIQUE had galloped three times in its previous start. Mr Dalgety added that, in all of his time in harness racing, he had never known of a horse being “put out” after being hit from behind.  It was common for a wheel to be struck from behind but not for the horse to break as a consequence. He stressed that TELEMECANIQUE broke several times in its previous start “of its own accord”.

The Committee found that, with approximately 1200 metres to run, TELEMECANIQUE was leading the field with BAND ON THE RUN trailing the leader. At that point, BAND ON THE RUN was allowed to strike the sulky of TELEMECANIQUE, the strike being a significant one – the sulky shaft of TELEMECANIQUE could be seen on the video to bend markedly. As a result of the contact, that horse went off stride and veered out. Several of the following runners received checks – principally, MISTER GNP and PERAKI KING, and TELEMECANIQUE itself lost ground. The interference to those runners was caused by BAND ON THE RUN striking the sulky of TELEMECANIQUE while trailing that runner.

The Committee was satisfied that the progress or chances of those three runners were interfered with as a consequence of the interference caused by BAND ON THE RUN. In addition, BAND ON THE RUN may have gained an advantage by its actions. The Committee, having regard to the degree of interference and the consequences to at least three other runners was satisfied that it should disqualify BAND ON THE RUN from the Race.

The protest was upheld accordingly and BAND ON THE RUN was disqualified from the Race. Consequent upon the disqualification, the amended placings for the Race are as follows:
