DECISION AND REASONS:
--An information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Public Trainer, Mr C T Dalgety, alleging that Mr Dalgety, as the trainer of JANICE FRANCO, "failed to present JANICE FRANCO to race on the 3 January 2007 at the Timaru Harness Racing Club meeting in Race 8 being scratched by Stewards".
----The information was served on race day and was heard at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on Thursday, 4 January 2007.
----Mr Dalgety had signed the "Statement by the Defendant" on the information form indicating that he admitted the breach and, further, that he did not wish to be present at the hearing of the information.
----The charge was found proved.
----Mr Dalgety's explanation, as given to the Stipendiary Stewards, was that he had nominated the horse a week prior to nominations closing and had then gone away for Christmas. The horse had then got sick and was not worked. Mr Dalgety had forgotten that he had nominated the horse and was not aware that it was in the field.
----Mr Escott recommended a fine of $150.00.
----Mr Dalgety was fined the sum of $150.00.
