Decision:

Under Rule 869 (8) (b) Stipendiary Steward Mr P T Knowles alleged that "with approximately 50 metres to run DAISY'S DREAM, driven by R M Tither, shifted ground sharply checking CYNICAL VIEW



Under Rule 869 (8) (b) Stipendiary Steward Mr P T Knowles alleged that "with approximately 50 metres to run DAISY'S DREAM, driven by R M Tither, shifted ground sharply checking CYNICAL VIEW, driven by C J Barron".

Mr Knowles, assisted by Stipendiary Steward Mr C Allison, showed side on and front on video evidence. He claimed Mr Barron, driver of CYNICAL VIEW, was coming through inside DAISY'S DREAM which had drifted out when DAISY'S DREAM under a drive sharply ran in and interfered with CYNICAL VIEW costing him any chance of finishing in a placing.

Mr Barron said he was in with a chance and was going to go outside Mr Tither's horse when it drifted out - so he took the inside run which was clear. Just then Mr Tither's horse ran in sharply and caused him severe interference.

Mr Tither agreed that he had run out then in and caused the interference but claimed that VIVA LA CC which only finished fourth was going better than CYNICAL VIEW, driven by C J Barron, so the best he would have finished was 5th.

DECISION

--

I find that Mr Tither's horse DAISY'S DREAM ran out and then sharply in causing severe interference to Mr Barron's horse CYNICAL VIEW, which cost him any chance of finishing in a place.

--

I relegated no 3, DAISY'S DREAM from second to eighth, and promoted no 5 to 2nd, no. 2 to third and no. 8 to fourth.
