Decision:

Following Race 9 an Information was filed pursuant to rule 638 (1) (D). The Informant, Mr Coles, alleged that Miss Myers permitted her mount THE LADY to drift inwards near the 600 metres when not sufficiently clear of WORTHING (B Lammas) which was checked.

Following Race 9 an Information was filed pursuant to rule 638 (1) (D). The Informant, Mr Coles, alleged that Miss Myers permitted her mount THE LADY to drift inwards near the 600 metres when not sufficiently clear of WORTHING (B Lammas) which was checked.

Miss Myers pleaded guilty and was represented by Trainer Mr L Noble.

Mr Oatham demonstrated the video films which clearly showed THE LADY racing in a 3 wide position approaching the 600 metres. On the point of the turn she allowed her mount to roll in to a 2 wide position.  In doing so she moved into the line of WORTHING when insufficiently clear of that runner causing Mr B Lammas to check.

Mr Noble speaking for Miss Myers said he believed the interference was minimal and on the point of the bend it can often look worse than it actually is.

PENALTY SUBMISSIONS

Mr Coles produced Miss Myers’ record which showed 3 charges in the last 12 months.  He believed this offence today was at the lower end of carelessness.

Miss Myers said she had commitments until the conclusion of racing on 21 November 2009.  She also confirmed she did intend riding at Timaru on 26 November 09.

PENALTY

--

The Committee carefully considered all the evidence and submissions before imposing an appropriate penalty.  In addition to taking Miss Myers’ record into account we concur with Mr Coles that this offence was at the lower end.  Accordingly we impose a suspension on Miss Myers from riding in races which starts after racing on 21 November and concludes after racing on 27 November (4 days).
