Following the running of Race 10 The Village Goldsmith Douro Cup Mr. B.R.Jones lodged an information instigating a protest pursuant to the Rules of Racing alleging that High Octane or its rider placed first by the Judge interfered with the chances of Far Too Much placed fourth by the Judge
Following the running of Race 10 The Village Goldsmith Douro Cup Mr. B.R.Jones lodged an information instigating a protest pursuant to the Rules of Racing alleging that High Octane or its rider placed first by the Judge interfered with the chances of Far Too Much placed fourth by the Judge. The interference occurred over the final stages.
--The Judge's placings were:
--1st No.2 High Octane
--2nd No13 Makutuwai
--3rd No 12 Danny Cool
--4th No.7 Far Too Much
--The margin between third and fourth was ? length.
--The information was filed with the registrar within the time prescribed.
--Present during the hearing were Mr.Jones and Mrs A.Herbert representing Far Too Much.
--High Octane was represented by Mr.L.Innes, Mr Ben Foot and Mr Peter Stewart.
--Mr. Jones began by showing the films of the incident. He pointed to Mr Innes racing down on the fence while his mount was out wider on the track with horses between them. He said that a gap opened up for him but as he went for it Mr Innes came off the fence approximately eight horse widths hindering his line by pushing another horse(Old Belvedere) onto him and costing him third dividend. He was unable to ride his mount out fully to the line. Mrs Herbert told the committee that the horse pulled up full of running and had had a very unlucky run.
--Mr Innes asked Mr Jones why he angled inwards looking for a run when there was room outside him. He maintained that the interference Mr Jones suffered was of his own doing as he angled his mount inwards. Mr Innes said that his own outward movement had no bearing on the interference.
--Mr George was invited to make submissions and he showed the video again. He said it was obvious that the interference occurred when Mr Jones made contact with Old Belvedere, the horse on his inside, as he angled in looking for a run. He said that it was only after this interference that Mr Innes moved across and may have taken his line but if he did it was right on the finish post. It was the opinion of Mr George that even clear of interference Mr Jones would not have finished in 3rd place therefore the protest should be dismissed.
--Decision
--Rule 876 (1) requires us to ask first whether interference occurred and then, if so, whether that interference has cost the horse interfered with a chance of finishing in a better position.
--We are satisfied having viewed the films and listening to the evidence that some interference has occurred. We are not satisfied however that Mr Innes riding High Octane was entirely to blame for the incident. Mr Jones was crowded for room by Old Belvedere but it was the opinion of the committee that he was the author of his own misfortune when he attempted a marginal inside run. We are also not convinced that the interference cost him the chance of finishing in a higher position.
--For these reasons the protest is dismissed and placings are allowed to stand as called by the Judge.
