At the meeting held on 29 March 2009 an information was lodged by the Stipendiary Stewards against Mr B G Woodhouse alleging a breach of the Notification of Drivers Regulations in that Mr B G Woodhouse failed to declare a driver for Lucky Pat in race 8 by the official notification time which was 1.00 p.m. Thursday 26 March 2009.

At the meeting held on 29 March 2009 an information was lodged by the Stipendiary Stewards against Mr B G Woodhouse alleging a breach of the Notification of Drivers Regulations in that Mr B G Woodhouse failed to declare a driver for Lucky Pat in race 8 by the official notification time which was 1.00 p.m. Thursday 26 March 2009.

At the outset of the hearing the Committee acknowledged that Mr Woodhouse did not admit the breach and did not intend to appear at the hearing.

Mr McIntyre, for the Stipendiary Stewards, said that when Mr Woodhouse was approached regarding the notification of driver he had assumed that Mr N Williamson would be available.  Mr Williamson is currently in Australia at a Junior Drivers event and it was not until after the notification time Mr Woodhouse became aware of Mr Williamson’s unavailability.

The Stipendiary Stewards submitted that Mr Woodhouse should have known that Mr Williamson was not available and should have confirmed Mr Williamson’s availability prior to nominating him as the driver for Lucky Pat.  The Committee accepts that Mr Woodhouse’s oversight in not checking Mr Williamson’s availability places the responsibility on him and, accordingly, the charge is found proven.

The Committee, after giving consideration to the Stipendiary Stewards view as to penalty, imposes a fine of $50.00.
