Decision:

Following the running of the NZCT Wellington Hurdles Mr J. Gillies, rider of the winner, VAN WINKLE, was charged with a breach of rule 871(3). That rule prohibits any rider from making any celebratory gesture prior to his horse passing the winning post.

Mr Gillies denied the charge.

Mr Goodwin with assistance from Mr Ray used the side on film of the finish to assert that Mr Gillies had stood up in the stirrups 30 metres from the line (which the stewards had no real issue with) and made two "fist pumps". Particular exception was taken to the "fist pumps". VAN WINKLE won by 5 lengths.

Mr Gillies responded by claiming that he was looking to slap his mount on the shoulder to keep him going but did not need to.

The Committee noted that stipendiary stewards have rightly been taking a firm stance on extravagant and exuberant behavior by riders before the finish. The bringing of this charge is consistent with the steward's zero tolerance on this matter. Our view of the films however is that there is some doubt that Mr Gillies' actions meet the test of a celebratory gesture. Even on an unfavourable view they indicate little more than a private restrained sense of elation. Certainly his pre-post actions had none of the flourish, theatrics or general lapses in horsemanship which have previously earned the ire of officialdom. We therefore find that an important element of this charge namely proof of a celebratory gesture has not been established to the level required and we therefore direct that the charge be dismissed.
