DECISION:

--

Mr JS Bullard has been charged pursuant to Rule 876(1)(d) of riding carelessly. It has been alleged by the Stipendiary Steward that Mr Bullard allowed his mount to move inwards with approximately 800 metres to run, causing tightening to the inside runners "Envy Me" ridden by B Herd and "Southern Odyssey" ridden by J Cameron, who clipped a heel and fell.

Mr Bullard did not admit the charge against him.

Mr Ching called evidence from Mr Herd, the rider of "Envy Me" and from Miss Cameron the rider of "Southern Odyssey".

--

Both described that they had encountered tightening from the outside which was caused by JS Bullard. Mr Herd said that he called out twice, and Miss Cameron said she called out once, for relief. However, the pressure did not come off. Miss Cameron's horse bounced off the rail into Mr Herd's mount, and fell. Mr Bullard accepted Mr Herd's evidence and enquired of Miss Cameron if she was "travelling, to which Miss Cameron replied that she was "holding her own".

The video coverage supported the oral evidence given. The evidence that is apparent to us is that Mr Bullard dictated Mr Herd's line and that when he was asked to relieve the pressure, and we find as a fact that he was asked a total of three times to do so, that instead, he allowed his horse a gradual inward movement inwards instead of relieving the pressure. We find as a fact that he had the ability to relieve the pressure notwithstanding Mr Bullard's statement to us that he could not do so because of the presence of DG Bradley on "Nobel".

Thus, by not allowing the inward movement, albeit it minimal and gradual, the fact of the matter is that he left Mr Herd in a difficult situation and as a consequence, Miss Cameron, in an impossible situation, and there was a fall. Therefore, having regard to the totality of the evidence, we are satisfied that the charge has been proved.

PENALTY

--

In considering penalty we take into account Mr Bullard's good riding record and the fact that he has not faced a careless riding charge for approximately 11? months. Having regard to the number of rides that Mr Bullard has on an annual basis, that is a good record indeed.

We also take note of Mr Ching's comment that the movement was minimal. Mr Ching, however, called for a suspension. Mr Bullard believed that the matter could be dealt with by way of a fine because of his good record, in particular. However, the aggravating feature in this case is horse and rider safety. There was a fall and that we have found was caused by Mr Bullard.

Because of that fact, a suspension is the only penalty that we can impose. We are therefore going to impose what effectively will be a one week suspension. Mr Bullard will be suspended from the conclusion of racing on 10th May 2006 until the conclusion of racing on 13th May.
