An information lodged by Stipendiary Steward Mr J Muirhead against Mr C Thornley, driver of HOLIDAY LOVER, placed second by the Judge, alleging a breach of Rule 869 (2) (a) ? excessive use of the whip - in that Mr Thornley used his whip excessively over the concluding stages of the race. Mr Thornley admitted the breach and did not wish to be present at the hearing. Mr Muirhead demonstrated the incident by use of the video film. Mr Thornley hit his horse about 28 times in the home straight, most of the use being of a minor nature. The horse was hit about 20 times continuously. Mr Muirhead said that Mr Thornley's explanation was that it was a close finish in a big race. The race was of Group 1 status.

PENALTY :

Mr Muirhead recommended a fine of $300 in line with other penalties for recent similar breaches. He said Mr Thornley had no relevant breaches of the Rules recorded against him. In fixing penalty the Committee took into account the following matters :

  3. The submissions of Mr Muirhead.
  4. --
  5. The explanation of Mr Thornley.
  6. --
  7. Mr Thornley's clear driving record.
  8. --

In balancing those matters, the Committee imposed a fine of $300.00.
