Following Race 2 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Mr L McCutcheon, that early in the run home Mr M Coleman, the rider of HAYLEE BAYLEE angled his mount out when not clear of TITIAN (C Lammas) resulting in interference to that runner.

Decision and Reason:

Following Race 2 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Mr L McCutcheon, that early in the run home Mr M Coleman, the rider of HAYLEE BAYLEE angled his mount out when not clear of TITIAN (C Lammas) resulting in interference to that runner. Mr Coleman pleaded guilty to the charge.

Mr N Goodwin, Assistant Stipendiary Steward, demonstrated the video film which clearly showed Mr Coleman on HAYLEE BAYLEE force a run outwards which resulted in contact being made with Mr C Lammas on his outside. This caused a bump to Mr Lammas' mount causing him quite a severe check.

Mr Coleman in his statement said he thought they would sprint home and he would have room. He said STARBO rolled out which didn?t help him and Mr Lammas held his line. He admitted it was an error of judgement and the interference looked worse than it was. He also said he was travelling to Penang next week and hoped to ride there over the next 2 weeks. He had already paid a $1200 airfare.

Mr McCutcheon said he believed the interference was not of a minor nature and a suspension should be imposed. He also produced Mr Coleman's record, which showed two other suspensions under this rule this year, being a 3-day term on 13 April 2005 and the same on the 30 April 2005.

The committee considered all submissions on penalty and have taken into account Mr Coleman's record and his guilty plea. We do not believe Mr Coleman's upcoming Penang trip constitutes an exceptional case where a deferment should be allowed. He is not representing his country or indeed has any firm riding engagements. Mr Coleman in this charge blatantly forced a run out causing quite a severe check to Mr Lammas, an indiscretion we believe warrants a term of suspension.

Accordingly we impose a suspension to begin after the conclusion or racing on 31st August and finish after the conclusion of racing on 10th September 2005 (4 days).
