--Information 7352 ? Stipendiary Steward Mr A Ray alleged that Mr I Khairil, rider of SPRINGTIDE, allowed his mount to shift inwards near the 600 metres
--Information 7351- Stipendiary Steward Mr A Ray alleged that Mr I Khairil, rider of SPRINGTIDE allowed his mount to shift inwards near the 900 metres

DECISION & REASON
--Two informations lodged under Rule 871 (1) (d), in same race.
--Information 7351- Stipendiary Steward Mr A Ray alleged that Mr I Khairil, rider of SPRINGTIDE allowed his mount to shift inwards near the 900 metres when not clear of ERBALBERT, ridden by C Ormsby, who had to be checked.
--Information 7352 ? Stipendiary Steward Mr A Ray alleged that Mr I Khairil, rider of SPRINGTIDE, allowed his mount to shift inwards near the 600 metres when not clear of ERBALBERT, ridden by C Ormsby, who had to be checked.
--Video evidence of both incidents was shown by Stipendiary Steward Mr Davidson and in both instances it was clear that Mr Khairil had allowed his mount to shift in when not 1 length plus 1 length clear causing Mr Ormsby to be checked on each occasion.
--Mr Khairil, in mitigation, stated that his horse was "as green as grass".
--As Mr Khairil admits both offences and this is backed up fully by the video and oral evidence we find the charges proven.
--PENALTY
--Submissions as to penalty were heard. Mr Ray stated that Mr Khairil had had two previous charges upheld in the past twelve months. Mr Ray originally asked for a 3 day suspension for each charge ? a total of 6.
--Mr Hamilton said Mr Khairil needed race day riding experience on better horses and he was endeavouring to arrange this. Mr Hamilton said that Mr Khairil was likely to have rides available at the National meeting but a 6 day suspension would prevent this. Mr Davidson confirmed that the National Meeting starts on 2 August 2007. Mr Ray then said he would not oppose Mr Kihairil riding at the National meeting and he would not oppose a suspension up to and including 31 July 2007.
--Taking all the above into consideration and giving credit for Mr Khairil's early and frank admissions we suspend Mr Khairil's licence up to and including 31 July 2007 ? a total of 4 South Island meetings.
