Decision: -- Following the running of Race 8, The Railway Hotel Otaki Cup, an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr S. G. Dickson, driver of "Cantina" (3), alleging a breach of Rule 869(3)(b). The charge was that Mr Dickson drove carelessly when he improved his horse outwards with 400 metres to run causing "China Goddess" to be checked and break, with resultant interference to "Glengarry Sunrise" and "Smart Cullen". Following the running of Race 8, The Railway Hotel Otaki Cup, an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr S. G. The charge was that Mr Dickson drove carelessly when he improved his horse outwards with 400 metres to run causing "China Goddess" to be checked and break, with resultant interference to "Glengarry Sunrise" and "Smart Cullen". Mr Dickson had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. He also agreed that he understood the charge and the Rule it was brought under. Stipendiary Steward Mr Renault used video coverage to show this incident, the details of which were as set out above. Mr Dickson had little to say and accepted that he had made an error of judgement. Penalty: In relation to penalty Mr Renault advised that Mr Dickson had no previous relevant convictions. Mr Renault also said that three other runners had their chances seriously affected, and he recommended a fine of $400-00 or a two week suspension. Mr Dickson said that he would prefer a fine to a suspension. We adjourned to consider the matter of penalty. We were satisfied that Mr Dickson should be given credit for his admission of the breach, and for his clear record. On the other hand this was a relatively serious breach in that three horses had their chances affected. Taking all these matters into account we were satisfied that the fine recommended was appropriate and Mr Dickson was fined the sum of $400-00. J M Phelan Chairman
