Following race 4 an information was filed pursuant to Rule 871(1)(d).  The informant Mr Oatham alleged that Mrs L Satherley, rider of BATMAN BRODIE, allowed her mount to shift in when not clear near the 1000 metres causing a check to ALBERCHENO (C Parish). 



DECISION & REASON:

Following race 4 an information was filed pursuant to Rule 871(1)(d).  The informant Mr Oatham alleged that Mrs L Satherley, rider of BATMAN BRODIE, allowed her mount to shift in when not clear near the 1000 metres causing a check to ALBERCHENO (C Parish).

Mrs Satherley pleaded guilty to the charge.

Mr Williamson demonstrated the video films and showed where at the 1000 metres, Mrs Satherley riding BATMAN BRODIE going forwards towards the lead, moved inwards and take the line of ALBERCHENO when only three-quarters of a length clear of that runner.  This caused Mr Parish to take a hold with a resultant check.

Mr Oatham submitted this offence was at the lower end of carelessness and warranted a 4 day suspension.  He said Mrs Satherley had incurred 3 suspensions in the past 12 months.

Mrs Satherley said she had commitments up to 1 November.

PENALTY:

The Committee considered all submissions and before imposing a fair penalty took into account the following:

--

 

--

1.            Mrs Satherley’s guilty plea.

--

2.            Her riding record.

--

3.            Degree of carelessness which we believe was at the low end of carelessness. 

--

 

--

Accordingly we impose a suspension for Mrs Satherley to serve starting after racing on 1 November and concluding after racing on 7 November (4 days).
