FACTS:
Information No. 69546 was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Public Trainers, Mr G P & Mrs N M Hope, alleging that Mr & Mrs Hope, as the trainers of HOLME GROWN, a runner in Race 6, Coca-Cola Amatil NZ Claimers (Heat 1) Mobile Pace, “presented HOLME GROWN to race in inadequate shoes which required the attention of the farrier prior to the start”.
The information was filed with the Registrar on racenight, served on Mr Hope at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on 29 July 2011 and heard during the course of that meeting. It was explained to the Committee that Mr Hope had refused to admit a breach of the Rule under the Minor Infringement System, hence the necessity for filing an information.
Mr Hope had signed the Statement by the Defendant on the information form indicating, firstly, that the breach was admitted and, secondly, that he did not wish to be present at the hearing of the information.
SUBMISSIONS:
Mr Ydgren informed the Committee that the shoes of HOLME GROWN were in “terrible condition” and were required to be attended to by the farrier prior to the start of the race.
DECISION:
Mr & Mrs Hope having admitted the charge, the charge was found proved.
PENALTY SUBMISSIONS:
Mr Ydgren stated that the fine prescribed for a breach under the Rule was $200 and he submitted that a fine of that amount was appropriate. Mr & Mrs Hope had a clear record under the Rule, he said.
REASONS FOR PENALTY:
In determining penalty, the Committee took into account Mr & Mrs Hope’s admission of the breach and their previous good record. Although Mr Hope was not prepared to accept a fine under the Minor Infringement System, it was nevertheless appropriate to impose a fine of the amount provided in that system.
PENALTY:
Mr & Mrs Hope were fined the sum of $200.
